Abstract

The adequate balancing of conflicting rights constitutes an essential task of political ethics. This paper proposes a fundamental rule that may govern this balancing procedure. The rationale of this rule is explored and specifications of its parameters are investigated by discussing various scenarios of conflict, in particular decisions of life and death. However, a certain type of choice situation seems not to allow for a stable solution within this theoretical framework, displaying the phenomenon of ‘ethical oscillation’ in which legitimacy and illegitimacy of the actions considered constantly alternate.
