N2 - This paper is focused on the juridical nuances of the ownership during the modernity. For doing so, I analyze the disputes over the jurisdiction of the saws of Aralar-Enirio that occurred during the seventeenth century, after fourteen hamlets achieved the privilege of township in 1615. By observing those kinds of conflicts in the small scale, the main idea is to inquiry on the juridical tensions that defined and modified the conceptions of land ownership during modernity, particularly on the concepts of possession, property, use and exploitation of land, as well as the tension between its particular and collective meaning.
